Terms of Use
Updated: 12 October 2026
These terms govern the use of Dishment, the restaurant management system made up of Back Office, the till and waiter apps, the kitchen display, the hub and the modules (the "Service"). "Dishment", "we" and "us" mean the company that provides the Service; its details are on the Contacts page. "Client" and "you" mean the company or sole trader that uses the Service for its venues.
By starting a trial, switching on a module or paying an invoice, you accept these terms. If you have signed a separate agreement with us, that agreement prevails where the two differ.
1. The Service
Dishment is provided as a subscription. The base plan covers the company account and the core features: the till, the waiter app, the kitchen display, menu, halls, staff and core reports. Paid modules, such as Advanced reports or Warehouse and recipes, are switched on separately in Back Office. Features marked "coming soon" are in development and are not part of the Service until they are released.
We may add, improve or change features while keeping the main purpose of what you pay for.
2. Free trial
A new client gets a free trial with the base plan and the ready modules — 30 days unless agreed otherwise. No payment card is needed. When the trial ends, the subscription carries on by itself and the paid period starts with the next full month. If you do not want to continue, write to support before the trial ends and no invoice will be issued.
3. Prices and invoices
- The monthly payment is the company's base plan plus the modules switched on. The base plan covers several venues and each further venue is charged monthly; modules are priced once for the whole company. Current terms are on the pricing page. There is no fee per device.
- Current prices are on the pricing page and in Back Office. We announce price changes at least 30 days ahead, by e-mail or through support; a new price applies from the next full month.
- On the 1st of each month, an invoice for the previous month is issued in Back Office: the base plan and every module that was on during that month. A module switched on during a month is billed for the whole month.
- The invoice must be paid within the term stated on it, by bank transfer with the invoice number in the payment reference, or in another way agreed with us.
- Invoices are issued in Azerbaijani manat.
4. Late payment
If an invoice is not paid on time, the Service keeps working in full during a grace period, and a reminder appears in Back Office. If the invoice is still unpaid after the grace period, paid modules are switched off. The base plan keeps working: the till takes orders and payments, the kitchen receives orders, and your data stays intact — core sales never stop because of an unpaid invoice. Once the invoice is paid, the modules come back.
5. Switching modules on and off
- The company owner switches a module on in Back Office, and it starts working right away.
- If a new module does not suit you within the first 7 days, write to support: we switch it off and do not charge for it.
- After that, a module is switched off at the end of the current month on request to support; that month is paid.
- To end the subscription, write to support; the Service works to the end of the month, and the last invoice covers that month.
6. Your account and acceptable use
You are responsible for:
- who you give access to, your staff's roles and permissions, and keeping passwords and PINs secret;
- the accuracy of the data you enter (menu, prices, staff);
- complying with the laws that apply to your business, including tax and consumer rules. Dishment is a management system, not a fiscal cash register (NKA); issuing fiscal receipts where the law requires them is the Client's obligation;
- the personal data of staff and guests that you put into the Service (see the Privacy Policy).
You may not:
- try to access other clients' data or our systems beyond your own account;
- interfere with the Service or put an excessive load on it;
- decompile the software, except where the law expressly allows it;
- resell the Service or give access to people outside your business without our consent;
- use the Service for unlawful activity.
For serious breaches of these rules we may restrict access, warning you first where possible.
7. Availability and the hub
We work to keep the cloud part of the Service available around the clock and, where possible, schedule maintenance for quiet hours. The hub — the program on the venue's main Windows computer — lets orders, kitchen tickets, payments and printing carry on when the internet or our cloud is unavailable; data syncs automatically once the connection is back. For this, the hub's computer must be switched on and connected to the venue's local network.
You are responsible for your own equipment, power supply and local network; we help you set them up. We do not guarantee that the Service will never have errors or interruptions.
Guests' online and QR orders (the Delivery module) are received in the cloud and passed to the venue's hub. If the hub is unreachable for a few minutes, new guest orders are not taken; an order already sent is delivered once when the connection is back, and one not answered in time is turned down by itself. The order, its price, delivery and payment are between the venue and the guest; Dishment passes the order on and is not a party to it.
8. Your data
Your data belongs to you. We process it to provide the Service, as described in the Privacy Policy. Reports can be exported from Back Office as CSV at any time. On request, including when the subscription ends, we prepare an export of your data in a common format. We keep the data for at least 30 days after the subscription ends so you can ask for an export; after that we may delete it.
9. Limitation of liability
- The Service is provided as is; we make good-faith efforts to keep it working.
- We are not liable for indirect losses: lost revenue or profit, missed orders, or damage to reputation.
- Our total liability for any claim is limited to the amount you paid for the Service in the 3 months before the event that gave rise to the claim.
- We are not liable for failures caused by your equipment, your internet provider, power cuts, third-party services or circumstances beyond our control (force majeure).
- Nothing in these terms limits liability that cannot be limited under the law of the Republic of Azerbaijan.
10. Changes to these terms
We may update these terms. We publish the new version on this page and tell you about significant changes by e-mail or through support at least 14 days in advance. If you do not agree, you can end the subscription before the changes take effect; continuing to use the Service means you accept the new terms.
11. Governing law and disputes
These terms are governed by the law of the Republic of Azerbaijan. We will first try to settle any dispute through negotiation; if that fails, the dispute will be resolved by the competent court in Baku in accordance with the law.
