How it is calculated

How vacation pay is calculated: the formula

Under Article 140 of the Labour Code, vacation pay is based on the pay for the 12 calendar months before the month the leave starts:

  1. Add up the pay for the last 12 months.
  2. Divide by 12: that is the average monthly pay.
  3. Divide the average monthly pay by 30.4: that is one day’s pay. 30.4 is the average number of calendar days in a month over a year.
  4. Multiply one day’s pay by the calendar days of leave.

In short: vacation pay = last 12 months’ pay ÷ 12 ÷ 30.4 × days of leave. Compensation for unused leave is calculated the same way.

Which payments count

Every payment that is part of wages: base pay, sales commission, bonuses, allowances, night and overtime pay (Article 139). One-off payments outside the pay system are left out. The full list is set by the Cabinet of Ministers; if a payment is unclear, ask your accountant.

Months not fully worked (partly paid social leave, unpaid leave not at the employee’s initiative, idle time not caused by the employee) are replaced by the nearest fully worked months. If the employee has worked less than a year, the full calendar months actually worked are used: six months worked, divide by six.

Service days count the time actually worked for this employer. The extra days for children also apply to fathers raising children alone and to adoptive parents. Public holidays that fall within the leave are not counted or paid as leave days; the leave is extended by that many days (114.6).

In a restaurant this means a manager or head chef in the managers-and-specialists category may be entitled to 30 days. Check the category of the position in the employment contract and the staff schedule.

Three examples

Illustrative figures.

Cook, 1,200 ₼ every month, 21 days. 1,200 × 12 = 14,400 ₼; 14,400 ÷ 12 = 1,200 ₼; 1,200 ÷ 30.4 ≈ 39.47 ₼ a day; × 21 = 828.95 ₼.

Waiter, base pay and commission vary month to month, 21 days. Earned 11,200 ₼ over 12 months (commission was higher around Novruz and in summer). 11,200 ÷ 12 ≈ 933.33 ₼; ÷ 30.4 ≈ 30.70 ₼ a day; × 21 = 644.74 ₼.

Barista, six months in the job, 14 days. Earned 5,900 ₼ in six months. 5,900 ÷ 6 ≈ 983.33 ₼; ÷ 30.4 ≈ 32.35 ₼ a day; × 14 = 452.85 ₼.

The calculator rounds the daily figure for display only and works out the total from the unrounded number. Rounding the daily pay to the qəpik first and then multiplying gives a result a few qəpik off.

When vacation pay is due

No later than 3 days before the leave starts (140.5). An employment or collective agreement may set another date, but no later than the next payday. If the money is late, at the employee’s request the leave can start from the day it is actually paid.

Vacation pay is wages too: income tax and insurance are withheld from it. To estimate the take-home amount, use the salary calculator; which month it belongs to is for your accountant to decide.

What the calculator leaves out

  • Indexation: after a pay rise, earlier months may be adjusted in the way the law sets (139.2, 140.7). In that case check the result with your accountant.
  • Extra leave for hard or harmful work (Article 115), teachers’ 56-day leave and other special categories.
  • Maternity leave: that is a social insurance benefit paid under other rules.

Dishment · Staff and payroll

Twelve months of pay in one table

Dishment’s Staff and payroll module keeps the timesheet and a payroll sheet for every period: hours worked, base pay, sales commission, bonuses. Closed periods do not change and export to CSV, so the last 12 months’ figures are easy to take from there. It does not calculate vacation pay, tax or insurance.
